September 28, 2010 Town Board Meeting

TOWN OF JACKSONPORT BOARD MEETING
Tuesday, September 28, 2010 at 7 p.m. at the Town Hall

Chairperson Jeanne Majeski called the meeting to order at 7:04 p.m.

Pledge of Allegiance was lead by Al Scharrig.

Present: Chairperson Jeanne Majeski, Supervisor Randy Halstead, Supervisor Tom Wilson, Clerk Eileen Phetteplace and Treasurer Carol Oram.

Agenda. Motion (Tom/Randy/Passed) to accept the agenda for the September 28, 2010 meeting as presented.

Motion (Tom/Randy/Passed) to accept the minutes of the Town Board meeting of August 24, 2010 as presented.

Motion (Tom/Randy/Passed) to accept the minutes of the Town Board meeting of September 7, 2010 as presented.

Treasurer Report: Received September 13, $5738.95 from Door County Tourism Zone Commission for July collections. All other collections were from normal building permit fees and town invoices. It was quiet. -presented by Treasurer, Carol Oram.

Committee Reports. Joe Jarosh speaking as the chairman for the Jacksonport Parks Committee asked for direction from the town board on the park budget and five-year plan.

Joe Jarosh speaking as a member of the Jacksonport Community Marketing Funds Committee asked for $3,500, a portion of the room tax dollars, to be budgeted for the production of the 2011 Jacksonport area brochure.

Jeanne Majeski gave a report on the Door County Coastal Byway Committee. She invited anyone interested to join them at their next meeting on October 13, 2010 at 8:30 a.m. at the Sevastopol Town Hall.

Motion (Randy/Tom/Passed) to accept and approve payment of the invoices which had been submitted to the Town.

Public Comment. Dave Swanson acknowledged that he was given a 30-day written notice to remove some rocks from his property in the road right-of-way for Clark Lake Court. He would have preferred a phone call. He did request a no parking sign be posted there.
The County Board is scheduled to meet at 9:00 am on Thursday, September 30th.
Amanda Surfus from the Door County Soil & Water Conservation office reminded the board that there is still funding available for the plan designed by Miller Engineers & Scientists, June 2008, for the Lakeside Park project. They are offering cost sharing again. They would appreciate knowing by October 29th if the Town plans to implement the plan. The amount available will be determined by how many municipalities apply for the funding. For estimating purposes the cost share would be at about 70% and could be implemented in 2011 or 2012.
Motion (Jeanne/Tom/Randy) to appoint Bill Schleicher (5 years) and Patrick Fitzgerald (3 years) as the new members of the Fire Advisory Committee.

Motion (Tom/Randy/Passed) to allow the Fire Advisory Committee to explore the expenditure of capital dollars for equipment in 2011 rather than 2012.

Motion (Randy/Tom/Passed) to accept a land donation from Richard and Pamela Wegner. The land is given for road purposes and contains 6,039 square feet (0.14 acres). It is located at the intersection of North Cave Point Drive and Jorns Road.

Motion (Jeanne/Randy/Passed) to order a cardboard recycling dumpster from Veolia and to purchase two recycling containers for Lakeside Park.

Joe Jarosh presented the five year plan/budget for the Parks Committee.

Petition for Zoning Amendment - Petition for Zoning Amendment - Map (Applicant: Thomas Lutsey) – Tax Parcel No. 016-00-02292711B [The petition is to effect a change in the Zoning Classification of real estate, located at Fire No. 7281 Logerquist Road as follows; from Natural Area (NA) Zoning District to General Agricultural (GA) Zoning District]. The land described will be used for proposed establishment of a farm market.

Motion (Jeanne/Randy/Passed) unanimously to support the request.

The Jacksonport Town Board voted unanimously in support of the application because the Town Board members felt the current use better fits the description for General Agricultural area than it does the Natural Area designation. Note the description for GA in the Door County Zoning Ordinance: “This district is intended to maintain agricultural lands which have historically demonstrated high agricultural productivity.” Also, there was no opposition to the requested zoning change expressed to board members from Jacksonport residents, neither before the meeting, nor during the public comment portion of the town board meeting.

Application for Conditional Use Permit (Applicant: Thomas Lutsey) – Tax Parcel No. 016-00-02292711B [A farm market is currently not an allowed use in the NA zoning district. A farm market is allowed with a Conditional Use Permit (CUP) in the GA zoning district. The CUP will not be scheduled for public hearing until a decision has been made on the rezoning.]

Motion (Tom/Randy/Passed) unanimously to support the request.

The Jacksonport Town Board voted unanimously in support of the application because the Town Board members felt the proposed farm market in Jacksonport would be a benefit to the community. Organic food production and sales is an up and coming business and would definitely represent a valuable asset to the area. Also, there was no opposition presented to board members neither before the meeting, nor during the public comment portion of their town board meeting.

Reminder that the Budget Workday will be held, October 19, 2010 6:30 pm at the Clerks home and Budget Hearing November 9, 2010 6:30 pm at the Town Hall.

Correspondence was made available to town board members.
