TOWN OF JACKSONPORT BOARD MEETING
Tuesday, November 27, 2007 at 7 p.m. at the Town Hall
The meeting was called to order at 7:00 p.m. by Chairman George Bagnall.
The Pledge of Allegiance was lead by Alvin Scharrig.
Present: Chairman George Bagnall, Supervisor Aaron LeClair, Supervisor Jeanne Majeski, Clerk Eileen Phetteplace and Treasurer Carol.
Agenda. Motion (Aaron/George/Passed) to accept the agenda for the November 27, 2007 meeting as presented.
Motion (Jeanne/Aaron/Passed) to accept the minutes of the regular Town Board meeting of September 25, 2007 as presented.
Motion (Jeanne/Aaron/Passed) to accept the minutes of the Fire Commission meeting of September 25, 2007 as presented.
Motion (Jeanne/George/Passed) to accept the minutes of the regular Town Board meeting of October 23, 2007 after revised to include the language “Northeast Asphalt is willing to do the engineering work at no cost, no obligation. The Door County Highway Department is willing to do the engineering work at no cost if they get the job.”
Motion (Aaron/George/Passed) to accept the minutes of the three meetings held on November 15, 2007 as presented.
Motion (Jeanne/Aaron/Passed) to accept the minutes of the Public Hearing meeting of November 12, 2007 as presented.
Treasurer Carol Oram reported as of October 31, 2007 a bank balance of $37,401.50. General transportation aids were paid in the sum of $22,289.52. A check has been received from Door County Tourism Zone Commission for the September report in the amount of $1,704.24. Total dollars collected for dog license in 2007 is $341.00. The State has adopted as of 2008 a 5-day extension for paying your property tax. Normally January 31st would be the deadline for 1’st installment of real estate taxes, that deadline would now be February 5th. The same would hold for the July payment and for future real estate tax payments. Carol wants people to be aware of the web site www.co.door.wi.gov under the quick link listing there are many categories that are very interesting and full of information. Tax collection hours will be as follows: December 22 from 10:00 a.m. until noon, December 28 from 6:30 p.m. until 8:00 p.m., January 26 from 10:00 a.m. until noon and January 30 from 6:30 p.m. until 8:00 p.m. Motion (Jeanne/Aaron/Passed) to accept the treasurer’s report as presented.
Meeting open for public Comment. Eric Wickstrom submitted six email messages from people opposed to open burning in the Schauer Road and Cave Point Estates area.
Tom Maher read a statement, a hard copy is on file with the official minutes from the November 27, 2007 and available from the Town Clerk.
Patrick Eaton is in favor of the Town of Jacksonport following State Statues 941.10.
Laddie Chapman asked the Town Board to be aware of Assembly Bill 207, which would change all agreements with cable companies. He asked that the subject be on the December Town Board meeting agenda.
Jim Parent explained that people have been trespassing on their property, by entering from the Town of Jacksonport gravel pit property. It has been a real problem for them, and he would like the Town Board to consider placing a fence, gate or chain on the entrance to the property.
Kari Anderson, as chair of the Jacksonport Land Use Committee, requests that the Town Board address Goal 2, Item 5 from the plan. “Obtain a Jacksonport-only amendment to county zoning which will apply more protective Multiple Occupancy Development (MOD or condo) regulations to the Village Core Area that are applied to densely developed villages like Fish Creek, including:
Density: 16 bedrooms per acre maximum
Height: 2 stories
Impervious surface area (buildings, driveways and parking areas which increase the volume and speed of stormwater runoff):
Maximum of 40% of lot surface area
Side and rear yard setbacks: 20 feet
County Board report by Kari Anderson. She made a point of asking people to complete the transportation survey that has been mailed out to all households in the County.
Driveway Ordinance. Motion (George/Aaron/Passed) to table until a later date.
Land Use Plan. Motion (Aaron/George/Passed) to adopt the “Town of Jacksonport Land Use Plan dated November 27, 2007” as revised by volunteer committee members; Kari Anderson - Chair, Alvin Scharrig, Paul Ozburn, J.R. Jarosh and Tom Wilson.
Motion (Jeanne/Aaron/Passed) to pass Budget Resolution No. 4-2007 –to allow the reallocation of funds from the Highway Snow Control account to the Highway Maintenance/Construction account and from the Attorney account to the Clerk account.”
Motion (Jeanne/Aaron/Passed) to include the survey form regarding sidewalks/footpaths in the Town of Jacksonport village core area with the property tax bills to be mailed out in December.
Chris Plzak, Forester, from the State of Wisconsin Department of Natural Resources talked about the Wisconsin Forest Fire Laws and Regulations. He said Door County is part of a co-op area. It is basically not deemed a high risk County. He suggested that we review State Statute 26 - “Protection of Forest Lands and Forest Productivity.” Motion (Jeanne/Aaron/Passed) to keep our burning permit process the way it has been for years.
The following letter was read by Eileen:
Dear Committee,
Two letters dated 11/15/2007 (both the same day) regarding open burning were sent to us anonymously. This is our response to those letters.
Regarding the first letter in which the author very nicely requests that burning be stopped, we find that we are in agreement. We are not planning to do any more open burning. However, we are a bit confused as no open burning has been done on our property since last Spring when there was still snow on the ground. In fact, when we heard of the meeting being called about burning, we chuckled to ourselves, thinking that Mr. Maher had found some other neighbor burning his or her brush.
We do appreciate the author's suggestions for alternatives. A wile ago we found that one could rent a wood chipper and have been looking into purchasing a used one. We were not aware of either of the drop off facilities but they may be useful for some of the larger deadfall. This letter was well written and we thank you for taking the time to do so.
As for the second letter which is a request for a meeting regarding the banning of burning at our address, we find that while there is a some content in here that is logical, it contains something absolutely incorrect and something dangerously foolish. The author writes that the issue of burning is not a question of laws or ordinances or that the burning was being done legally. Instead, he says the issue is question of "What is the value of burning to the Town of Jacksonport". This is absolutely incorrect. This issue is quite simply a question of law and ordinance. Period. If the author disagrees with the law and if good reasons can be found to change the law, then he should proceed accordingly.
The author requests that no burning permits be issued for our property. There is no mention that permits can't be issued for the people next door or down the street or on the next road over, just at our property. There is an aerial photograph in the letter showing thousands of acres in the area along with the opinion of a retired scientist that the tree species in this area are not resistant to fire. Is it the scientist's opinion that the only place in these thousands of acres that a fire could start is on our property? Does he think it is OK for everyone else to get burning permits except us? We seriously doubt it. This notion is dangerously foolish and we think that upon further reflection, the author and those who have signed it will agree.
We strongly object to this attempt to single out our property. Due to the obvious discriminatory nature of the request for the meeting, we ask that this portion of the meeting be canceled or the wording be changed such that this ban must be equally applied to everyone in the jurisdiction.

Motion (Aaron/Jeanne/Passed) to support the placement of a light at the Clark Lake Launch, provided the light is shielded or with a downward focus, and that the Town of Sevastopol shall be responsible for 50% of the annual cost of that light.
