December 9, 2004 Special Hearing (Jorns Road Request)

TOWN OF JACKSONPORT SPECIAL HEARING
Thursday, December 9, 2004 at the Town Hall

The special hearing to consider Thomas R. Jorns request for a public highway to his landlocked parcel of land in the Town of Jacksonport was called to order at 1:02 p.m. by Chairman Alvin Birnschein. Present: Chairman Alvin Birnschein, Supervisors George Bagnall and Jeanne Majeski, Clerk Eileen Phetteplace and Attorney Randy Nesbitt. There were approximately fifteen other people from the township present. Motion (Alvin/George/Passed) to adjourn and to meet on site.

Inspection of site performed - all supervisors personally entered onto property.

The special hearing called back to order at 2:07 p.m. immediately following the property inspection.

- fails to identify exorbitant price
- fails to identify price offered to Dietrich
Meeting not being held pursuant to statute
Savage claims he has not refused to grant an easement
Sent certified notice to Jorns prior to purchase that property had no legal access
Managed Forest Lands document referred to - refers to 40 acres even though tax bill is for 38 acres
Will not sell or give easement to Jorns to remove logs

Reports exaggerations by neighboring property owners
Suggests equity and interest of Town require that the Town provide access to landlocked property

- Has permission to access by water

Jean Fritschka
Wants to know if building road would provide public access to lake

Richard Dirk
Points out this is the third time the request has been presented to the Town Board
Access will benefit only Jorns
Town is not required to provide access
Requests that denial be made

Clem Hedeen
No environmental impact statement will be required

Bill Wolske summarized
Knowledge of landlocked status not relevant
