TOWN OF JACKSONPORT BOARD MEETING
Tuesday, December 21, 2004 at the Town Hall
The meeting was called to order at 7:02 p.m. by Chairman Alvin Birnschein. Present: Chairman Alvin Birnschein, Supervisors George Bagnall and Jeanne Majeski, Treasurer Carol Oram, Clerk Eileen Phetteplace and Legal Council Jim Smith.
Agenda. Alvin recommended moving up item 10 a. Tom Jorns request for road to his landlocked property, to follow the County Board Report. Motion (George/Jeanne/Passed) to accept the agenda, for the December 21st meeting as presented.
The minutes of the regular meeting of November 23, 2004, were ordered corrected to show the correct spelling of Wegner. Motion (Jeanne/Alvin/Passed) to accept the minutes of the regular meeting of November 23, 2004 as corrected and distributed.
Motion (George/Jeanne/Passed) to accept the minutes of the Special Hearing, December 9, 2004 as distributed.
Treasurers Report: Treasurer Carol Oram reported as of November 30, a balance of $233,376.44. The Town received
$1,863.96 from the County for recycling. She will be at the Town Hall to collect Property Tax payments on (November-error)December 29, 6:00 to 7:30 p.m., January 22, 10:00 until noon and again on January 28, 6:00 to 7:30 p.m. Received notice from the State our 2005 General Transportation Aids, $85,683.75, quarterly payments, the first one in January.
Motion (Jeanne/George/Passed) to accept the treasurer's report.

County Board report by Keri Anderson.
Tom Jorns Request for road to his landlocked property.
George Summarized the Road request considerations as follows:
1). As a Town Board we have received much correspondence from both sides - Pro and Con.
2). I have read Wis Stat 80:13 several times, and have listened to 2 1/2 hours of testimony during the
hearing of 12/9/04, as well as walking the land belonging to the Fischer family, where the road is
being considered.
3). I understand the position Mr. Tom Jorns is in. He has 40 acres landlocked, 1/4 mile from a public
road. Only access is by boat after crossing other private property.
4). Mr. Jorns bought the 40 acres, Sept. 14, 2001. He bought the land knowing it was landlocked. Prior
to the purchase he did very little if any research as to how he would get to the landlocked 40 acre
parcel.
5). Mr. Jorns states he will build 2 houses on the property if a town road is laid. This is only a verbal
commitment, so it is not a guarantee that the town tax base will grow.
6). He has submitted a cost of the proposed road to be $29,821. This does not include blacktopping,
permits, tree cutting approximately 400'+ cul-de-sac area, tree stump removal, ripping rock or blasting
if necessary.
7). A strong point in Wis Stat. 80.13 is "How well will this road serve the Public" This would be a dead
end road. It appears only Mr. Jorns and friends would benefit, not the public.
8). We have several other landlocked properties located in our town. If this request is granted the town
would be opening the door for many more roads to be laid at a huge cost to the town.
9). After considering all of the above, laying this road over the Fischer property in Section 6 of
Jacksonport is not in the Town of Jacksonport's best interest, so I oppose the Jorns petition to laying

Jeanne pointed out that the Town of Jacksonport has a Road Ordinance, and Standards for Road Acceptance that must
be considered. This proposed road would only benefit one property. She does not believe the proposed road is in the
towns best interest.
Alvin pointed out that the road must clearly be in the Public interest. The last road the Town accepted was in the 80's,
at the Rushes. He also said it would take a long time to recoup the cost of the road with the tax basis of 2 homes.
Motion (Alvin/George/Passed) to oppose granting the road at this time.
Motion (Jeanne/Alvin/Passed) to access the cost of the applicant, including attorney fees, any expert and survey fees
and to authorize Chairman Alvin Birnschein and Clerk Eileen Phetteplace to sign and file the order.
Update on Logerquist Road. Another Speed Survey was conducted:
December 8, 2004, 12:15 p.m. to 1:15 p.m., 25 Vehicles (15 south, 10 north) 33 mph (33.08) Average Speed
December 13, 2004, 4:00 p.m. to 5:00 p.m., 10 Vehicles (7 south, 3 north) 33 mph (33.5) Average Speed
December 16, 2004, 6:30 to 7:30 a.m., 8 Vehicles (4 north, 4 south) 30 mph (30.5) Average Speed
Motion (George/Alvin/Passed) (Jeanne opposed) to leave the Speed Limit at 55 mph until a clear cut problem exists.
Appoint poll workers for the next 2-year election period.
Motion (Alvin/Jeanne/Passed) to accept Republican poll workers as presented.

Motion (George/Alvin/Passed) to accept Democratic poll workers as presented.

Set date to audit books. January 27, 2005 at 7:00 p.m. at the Town Hall.
Transfer money from General account to insufficient funds: Motion (Alvin/Jeanne/Passed) to transfer $1,700 to
Legal (Attorney) and $1,300 to Miscellaneous Expenses from Zoning/Planning Budget.
Motion (George/Jeanne/Passed) to transfer $5,000 from Fire Dept. Wages & Expenses into Fire Department Savings Contingency Fund
