TOWN OF JACKSONPORT BOARD MEETING
Tuesday, August 28, 2007 at 7 p.m. at the Town Hall

The meeting was called to order at 7:02 p.m. by Chairman George Bagnall.

The Pledge of Allegiance was lead by Ben Logerquist.

Present: Chairman George Bagnall, Supervisor Aaron LeClair, Supervisor Jeanne Majeski, Treasurer Carol Oram and Deputy Clerk Marlene Larson. Absent: Clerk, Eileen Phetteplace.

Agenda. Motion (Jeanne/Aaron/Passed) to accept the agenda for the August 28, 2007 meeting as presented.

Motion (Jeanne/George/Passed) to accept the minutes of the regular Town Board meeting of July 24, 2007 as presented.

Treasurer Carol Oram reported as of July 31, 2007 a bank balance of $444,232.52. The school levy property tax credit from the Wis. Dept of Revenue was received in the amount of $215,319.67. The Town 2006 tax settlement for the second half of the property tax was paid from the county, in the amount of $122,863.78. General transportation aids were paid in the sum of $22,289.51. And $32.00 was paid for state computer aids. Also received from the State was the July shared revenues in the amount of $2,127.08. Motion (Jeanne/Aaron/Passed) to accept the treasurer’s report as presented.

Meeting open for public Comment. Tom Lutsey, Egg Harbor, spoke of his plans for his 160 acre property on the corner of Bagnall and Kiehnau Rd. He plans to put in a well, buildings, and fencing for cattle. He would be using wind energy as his source of power. A 120 ft wind tower was recommended. He has talked to his neighbors and wants others to know his plans for the property. His next step will be the Door County Planning Dept.

County Board report. Among items reported by Kari Anderson was a meeting by the Planning Dept. to hold a public hearing in Sept. on a wind energy ordinance for towers over 175 feet in height.

Town sidewalks. Jeanne indicated that the Bay Lakes Planning Commission would assist us in finding funding to install sidewalks and give us technical support. It was suggested that the property owners be contacted first. George had surveyed the village only and got mixed responses. Five said yes, 4 said no, and 5 were on the fence. Comments were: not on my side of the street, depends upon who will pay for the sidewalks, don’t need south of Town Hall Bakery because of lack of foot traffic, maybe from ballfield and south of Town depending upon where the curbing is located. Because the road is so wide, another option would be to line one side as a pedestrian and bike path instead of a parking lane. Motion (Jeanne/Aaron/Passed) to pursue with Bay Lakes Planning Commission, the question of what sort of grants are available for sidewalks in the Village.

Warning lights for the north and south ends of the Village. Sturgeon Bay uses solar lights which we may be able to use in Jacksonport if there is enough sun. They can operate 14 days without sun. Cost would be about $1200 per unit. Jacksonport Advancement Corporation may cost share on the project. Project will be on hold until the JAC has their budget meeting.

Amanda Brown, Door County Soil and Water gave an update on the Sewer Drainage System and Town Beach Contamination Reduction Project. She gave the Town Board a municipal contract/agreement for three years. She would like it back as soon as possible. After a rainfall the e-coli is considerably higher at the beach. The Wisconsin Coastal Management was hired to suggest programs to help solve this problem. The 2nd phase of the project would be the preparation of final construction plans. The 3rd phase would be the implementation of the project. Committing to the 2nd phase does not obligate us to the 3rd phase. The 3rd phase can be done by the town with the information provided if they want to proceed on their own. There are no guarantees that there will not be any closing of beaches with the project, but rains do raise the level of e-coli on the beach. Cost estimates for the final construction plans and maintenance manual will be $7,000 per beach with a 70/30 cost sharing with Soil and Water Conservation. Jacksonport’s share would be $2,100. They would like payment by March 1 if we are going to continue the plan. They would like a key person to be the contact person with the engineering firm.

Tourism Zone Ordinance. Our ordinance in hand already has amendments. George received a new copy of the ordinance with the amendments included. Motion (Jeanne/George/Passed) to adopt the Tourism Ordinance No. 02-2007 An Ordinance for the Collection of Tax on Overnight Lodging retro to May 1 with the amendments included.

Clark Lake Association proposed ordinance. Paul Schumacher, Clark Lake Advancement Association proposed a slow-no wake ordinance to protect the ecology of the East Bay of Clark Lake. He said that the Clark Lake Association membership approved the recommendations of the strategic plan by a vote of 41-2. Enforcement of the ordinance would be by the DNR. CLA would be responsible for purchase, maintenance, placement, and removal of the buoys to mark the area. The Ordinance must next be approved by the DNR who will hold hearings. This ordinance is identical to the one presented to Sevastopol Town Board. Several Clark Lake members viewed their opinions of the ordinance. Motion (Jeanne/Aaron/Passed) to support the approval of Town of Jacksonport Ordinance No. 03-2007 “A Sole Ordinance to Regulate Boating upon the Waters of Clark Lake and Prescribing Penalties for Violation” thru proper procedures with public hearings and DNR approval.

Driveway Ordinance. George distributed a copy of Egg Harbor’s ordinance. Aaron asked if this ordinance could be applied to existing driveway. Further discussion will be tabled until next month.

Town Gravel Pit. After discussion, it was decided not to take any action on placing a gate at the town pit.

Jacksonport Advancement Corporation. Terry Simon presented a list of items for future consideration for town improvements. They were:
1. Privacy partition for bathrooms at Lakeside Park.
2. New sign and posts for Erskine Park.
3. Six new frames needed for picnic tables
4. Stone for flower garden around Lakeside Park Sign.
5. New bases for the ballfield
6. Three more red maples for ballfield.
He gave a copy of these suggestions to the Women’s Club and the Jacksonport Advancement Corporation.

Budget Workday and Hearing. Budget workday will be October 18, 2007 at 6 p.m. at Eileen’s house. Budget Hearing will be November 15, 2007 at 7 p.m. at the Town Hall.

Preliminary population estimate. Motion (George/Aaron/Passed) to take no action on the population estimate of 797 for 2007.

1. Solar lights if JAC gets back in time for meeting
2. Driveway ordinance
3. Soil and Water Proposal
4. Jon Jarosh – report on tourism
5. Jeanne – Grant for sidewalk/footpath
6. Roads – TRIP program
7. Moving money from Contingencies to Highway
8. Insurance
9. Long range planning for park and funding for larger projects.

Invoices were submitted for approval.
